EB-5 Immigrant Investor Immigration
EB-5 is the employment-based immigrant category built around capital investment and job creation.
It can lead to lawful permanent residence for qualifying investors, but the immigration analysis should begin before funds are committed—not after an investment has been completed.
Current Investment Thresholds
For petitions governed by the post-2022 rules, the current statutory minimum is:
$1,050,000 generally
or
$800,000 for a qualifying investment in a targeted employment area or qualifying infrastructure project.
These amounts are subject to periodic inflation adjustment, so the applicable threshold should be verified before investment.
The Investment Is Only One Part of the Case
An EB-5 case can involve analysis of:
the qualifying commercial enterprise;
amount and timing of investment;
whether capital is properly at risk;
lawful source and path of funds;
job creation;
project documentation;
regional-center or standalone structure;
targeted-employment-area issues;
immigrant petition;
visa availability;
and the later removal of conditions on residence.
USCIS generally requires the investment to support creation of at least 10 permanent full-time jobs for qualifying U.S. workers
Regional Center or Standalone Investment?
Those are materially different structures.
A regional-center investment does not eliminate the investor’s immigration evidentiary obligations, including source-of-funds requirements.
A standalone investment can involve more direct operational and job-creation issues.
The immigration analysis should evaluate the structure rather than treating “EB-5 investment” as a single product.
Reserved Visa Categories
Current EB-5 law reserves portions of annual visas for qualifying rural, high-unemployment and infrastructure investments. Visa availability nevertheless changes over time and by category and country.
Before You Move the Money
The immigration lawyer is not performing securities due diligence or recommending an investment.
The legal role is different: analyzing whether the immigration structure and evidence can satisfy EB-5 requirements.
Financial, securities, tax and investment advice should come from appropriately licensed professionals.
Considering EB-5?
Review the immigration requirements before important capital commitments become difficult to change.
