O Visa for Extraordinary Ability or Achievement

The O classification is designed for qualifying individuals whose accomplishments place them at a high level within their field.

The category is often relevant to scientists, researchers, business leaders, founders, academics, artists, filmmakers, performers, athletes and other highly accomplished professionals.

O-1A

O-1A covers extraordinary ability in:

science;
education;
business; or
athletics.

O-1B

O-1B covers qualifying extraordinary ability in the arts and extraordinary achievement in motion picture or television.

The standards are not identical across every O-1 field.

The evidence strategy must match the particular classification.

Evidence Is More Than a Stack of Achievements

Awards, publications, media coverage, critical roles, judging, original contributions, high remuneration, commercial success and other evidence can matter depending on the field and legal standard.

But a persuasive O-1 case needs to explain what those accomplishments mean within the relevant field.

Who Files?

O-1 is generally filed by a U.S. employer or qualifying U.S. agent.

A beneficiary does not simply self-petition for O-1.

Agent structures can be particularly relevant where a qualifying person will perform services for multiple engagements or employers.

O-1 or EB-1A?

They can involve similar evidence, but they are not the same classification.

O-1 is temporary.

EB-1A is an immigrant classification connected to permanent residence.

The legal standards, procedural requirements and strategic objectives differ.
